agreement was a “reinstatement” of the January plea agreement.
Because the July agreement included these two significant changes from the
January agreement, it was not the same agreement. The July plea agreement did not
include a provision that the government would dismiss the remaining charges against Mr.
Brown if he cooperated. In addition, the July 2004 plea agreement did not include the
provision that the two men would go free if they cooperated with the government. The
government was therefore not bound to take advantage of Mr. Brown’s cooperation and
it was not obligated to dismiss any charges.
